Hadith 70
The Book of Divorce
It was narrated that Ash-Sha'bi said:
"I came to Fatimah bint Qais and asked her about the ruling of the Messenger of Allah concerning her. She said that her husband divorced her irrevocably, and she referred her dispute with him, concerning accommodation and maintenance, to the Messenger of Allah. She said: 'He did not give me (the right to) accommodation and maintenance, and he told me to observe my 'Iddah in the house of Ibn Umm Maktum,'"
أَخْبَرَنَا يَعْقُوبُ بْنُ مَاهَانَ، - بَصْرِيٌّ - عَنْ هُشَيْمٍ، قَالَ حَدَّثَنَا سَيَّارٌ، وَحُصَيْنٌ، وَمُغِيرَةُ، وَدَاوُدُ بْنُ أَبِي هِنْدٍ، وَإِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، وَذَكَرَ، آخَرِينَ عَنِ الشَّعْبِيِّ، قَالَ دَخَلْتُ عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ فَسَأَلْتُهَا عَنْ قَضَاءِ، رَسُولِ اللَّهِ صلى الله عليه وسلم عَلَيْهَا فَقَالَتْ طَلَّقَهَا زَوْجُهَا الْبَتَّةَ فَخَاصَمَتْهُ إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فِي السُّكْنَى وَالنَّفَقَةِ قَالَتْ فَلَمْ يَجْعَلْ لِي سُكْنَى وَلاَ نَفَقَةً وَأَمَرَنِي أَنْ أَعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ .
